What are we going to do?
Posted By Kay at 2:52 PM

While reading that more and more of our troops are being sent back on the battle field even though they have been diagnosed with PTSD  and other mental problems, brain injury or even physical injuries, I'd have to ask why  the pentagon and military not addressing these issues, all I've heard is they say they have a shortage of troops. But sending troops that have the problems above isn't going to help.

All I can think of is if  troops  or vets are not getting any response from the miltray to address these issues, can they sue? And if the VA  didn't cooperate, what about independent medical doctors, psychiatrists, what about documentation on the lack of treatment  and other documenting of  the problems our troops are suffering or medical records? I don't know much about this, but would appreciate comments.

Unfortunately when nothing else works our troops may have to take such drastic measure, being forced to go back on the battlefield will only complicate things for them.  What do they do to protect themselves then. Especially when they are not getting cooperation from the military or government to addess these issues and to deal with them promptly. How can  they not see the problems and not address the issues? I don't think this is an issue that can wait indefinitely or be put on hold. It's like a kick in the teeth for our troops . I don't know of other measures that can be taken, but it's not like our troops can walk off the job and say I quit when they are dissatisfied with things,a freedom that civillians enjoy, they have that choice ,our military men don't.

Things are made  harder for our troops to  find help , recover, and  to be able to cope with these stresses .If people have a pet who is wounded they wouldn't kick it out on the street , they would  get help and treatment for thei pet. Human beings  are treated with less respect, concern  and dignity that animals? Somehow I am reminded of the bible where Jesus confronted the religious leaders of his time, the the Pharisees, stating they made impossible religious demands on the people and put on men's backs burdens that  were  grievous to bear and lifted not a finger to ease the burden." Perhaps we can see how that applies to a men and women in uniform. While there is progress being made in certain ways it would be in the military's best interests to address these issues ,otherwise it will continue  destroy the morale of the troops. And more people will continue to look at the military unfavorably.

Kay,

I can answer a few of your questions. Can they sue? Not for damages or malpractice. They fall under what is called the Feres Doctrine, so if someone dies because they weren't treated, they are sol. What good is it if you can't afford an IMO because you're too disabled to work and there is no impetus to accept the IMO anyway? What are you going to do? You get denied, you file an appeal and wait 3 - 4 years for a hearing at the BVA another arm of the DVA. Denied again, then 3 more years to wait for a hearing at the CAVC. You see, often the DVA will fail to do something, like help the vet find records, or something will be found lacking so the CAVC remands the case back to the BVA or Regional Office. Is it a wonder vets give up or suicide? Please read my latest...best regards.

Thank you for your information, sounds like a really really difficult process for our troops,. I will read your article. I wonder if new legislation can be passed to change this process , I of course would be ignorant about what or how it would be changed.I actually wrote congress one time about giving our troops a two year haitus when they returned from war, paid leave.(not denying other benefits,or disability claims) I thought it might make it easier for them to to recuperate, and I asked congress how much would the expense be, compared to what our government is spending on other things like corporate welfare, this war etc. Needless to say they did not answer.
